40-year-old Brian Edwin Harris crashed his silver Ford F-150 into the north-side metal guardrail along Poplar Creek Road around midnight on July 20th. When officers spoke with Harris, he told them he “swerved to avoid an armadillo” and that he did not need medical attention. During this, they discovered he had been arrested on March 30th, 2005, and convicted on July 19th, 2005, for driving under the influence. Officers observed him showing signs of impairment, so they prompted him with sobriety tests, to which he agreed and performed poorly. Then, Harris was Mirandized, and after being read implied consent, he refused to provide a chemical sample. After this, officers obtained a warrant for a blood sample and transported him to Nashville General Hospital for a blood draw. Harris was then taken into custody for driving under the influence.
