23-year-old Max Porter Harper was found unconscious in front of Hard Rock Café at 3:20 a.m. on August 31st. Two concerned citizens noticed this and flagged officers down for assistance. Upon arrival, the police observed Harper passed out in a flower bed and tried waking him up several times. Officers also applied sternum rubs, but he was unresponsive, so they called the medics. Once the medics arrived, they woke Harper up, and he stated he had been consuming alcohol for “at least an hour.”

Harper could not tell officers where he was, where his friends and relatives were, where he would stay, or how he would get there safely. Then, Harper tried to use his phone to call a friend but had difficulty operating it. During their interaction, Harper had trouble answering their questions and seemed confused while showing signs of impairment. Then, Harper refused medical attention and was deemed a danger to himself. Harper was taken into custody for public intoxication.

Max Porter Harper was booked into the Metro Nashville Jail on August 31st, charged with public intoxication. A judicial commissioner set his bond at $100.
