DUI: Eric Babula scores 0.254% BAC after drinking 2 “glasses” of Bourbon before driving

40-year-old Eric Babula had a single-vehicle accident at a Harpeth Hills Drive residence on the afternoon of September 9th. When officers arrived, Babula was sitting in the driver’s seat. Officers instructed Babula to exit his vehicle. As he exited his vehicle, officers noticed he had a strong alcoholic odor coming from his breath and was visibly impaired.

When prompted, Babula consented to sobriety tests and performed poorly. Then, Babula was informed of implied consent and agreed to provide a breath sample, resulting in 0.254% BAC. Under Miranda, Babula told the police that he consumed two “glasses” of bourbon around 1 p.m. Babula was taken into custody for driving under the influence.

Eric Babula of Neighborly Ave in Nashville, TN, was booked into the Metro Nashville Jail on September 9th, charged with driving under the influence. A judicial commissioner set his bond at $3,000, and the Davidson County Sheriff’s Office gave him pre-trial release from their facility.
